HB 65 Representative James K Armes OPPOSED CIVIL SERVICE FIRE POL Provides relative to the classified police service in the city of DeRidder Proposed law retains present law but makes an exception for the city of DeRidder Provides that the position of secretary to the police chief is in the unclassified service and that the right of selection appointment supervision and discharge is vested in the police chief The Louisiana Fraternal Order of Police is OPPOSED to this Legislation This Legislation if passed as written would remove the Secretary to the Chief of Police in Deridder from the classified civil service The Louisiana Fraternal Order of Police knows that this is bad precedent that has the potential to cause irrevocable damage to the Louisiana Fire and Police Civil Service system In previous sessions several pieces of Legislation were passed that excluded Chiefs of Police and Assistant Chiefs of Police from the classified service Many of us were assured that this was just an upper echelon or leadership issue Well it appears with your Legislation the beginning of eroding the lower classes of employment has begun Also we find it peculiar that this bill removes the Secretary from the classified service but the Chief remains in the classified service Representative James K Armes Democrat District 30 District Info 2255 University Pkwy Leesville LA 71446 Phone 337 238 7004 Fax 337 238 7007 armesj legis la gov Find us online at www louisianafop com LAFOP LEGISLATIVE 2018

HB 140 Representative Walt Leger III SUPPORT PROBATION Provides for the use of supervision fees paid by offenders placed on probation or parole Present law provides that when the court places the defendant on supervised probation it shall order as a condition of probation a monthly fee of not less than 60 nor more than 110 payable to the Dept of Public Safety and Corrections or such other probation office agency or officer as designated by the court to defray the cost of supervision For all monetary assessments except supervision fees imposed as a condition of probation or parole present law authorizes the division of probation and parole to assess a collection fee of 10 of the funds due The 10 collection fee shall be appropriated to the Dept of Public Safety and Corrections to be reinvested in additional resources for the division of probation and parole Proposed law retains present law but provides that the fees collected pursuant to these provisions of present law may be used for the salaries of probation and parole officers Last year the LAFOP supported Legalisation that would give Probation and Parole officers a much needed pay increase The measure was stopped during the last days of the Session The LAFOP supports this Legislation Representative Walt Leger III District 91 935 Gravier St Suite 2155 New Orleans LA 70112 Phone 504 556 9970 Fax 504 556 9972 legerw legis la gov Find us online at www louisianafop com LAFOP LEGISLATIVE 2018

HB 164 Representative Sherman Mack SUPPORT SUPPLEMENTAL PAY Increases the amount of supplemental pay for eligible law enforcement and fire protection officers Present law provides for supplemental pay of 500 per month for any police officer paid by any municipality or by the Chitimacha Tribe of La Coushatta Tribe of La or the Tunica Biloxi Tribe of La who devotes his full working time to law enforcement and has passed a council certified training program and has completed one year of service Also includes certain police officers providing services while patrolling levees waterways riverfront areas and bridges within the city of New Orleans Proposed law increases the supplemental pay from 500 per month to 750 per month for eligible police officers The Fraternal Order of Police is in support of this Legislation Law Enforcement officers in Louisiana are daily protecting the citizens of the communities that they serve As the cost of living has increased over the previous years law enforcement has not seen an increase is State Supplemental pay since 2009 The LAFOP supports this Legislation Representative Sherman Mack District 95 P O Box 115 Albany LA 70711 Phone 225 567 3677 Fax 225 567 3679 macks legis la gov Find us online at www louisianafop com LAFOP LEGISLATIVE 2018

HB 405 Representative Ted James OPPOSED CIVIL SERVICE FIRE POL Provides that the positions of police chief and deputy police chief in the city of Baton Rouge are in the unclassified service Proposed law provides that any person who resigns from a position in the classified service to beappointed police chief or deputy police chief shall not forfeit his seniority accumulated to the date of his resignation Provides that no such person shall accumulate seniority during the time he is not in the classified service Further provides that if any such person resigns from such position or is terminated for any reason other than malfeasance in office he shall be eligible to be reemployed to the same position in the classified service in which he was employed immediately preceding his resignation from the classified service Provides that if the position has been filled or no longer exists then his former employer shall employ him to a comparable position This Legislation if passed as written would remove the Chief of Police and the Deputy Chief in Baton Rouge from the classified civil service The Louisiana Fraternal Order of Police knows that this is bad precedent that has the potential to cause irrevocable damage to the Louisiana Fire and Police Civil Service system The LAFOP is OPPOSED to this Legislation Representative Ted James 445 N 12th St Baton Rouge LA 70802 Phone 225 343 3633 Fax 225 342 9770 james ted legis la gov LAFOP LEGISLATIVE 2018 Find us online at www louisianafop com

HB 604 Representative Julie Emerson SUPPORT LAW ENFORCEMENT Provides for health insurance for the families of law enforcement officers killed in the line of duty Requires employer to provide and pay for health insurance for the surviving spouse and children of a law enforcement officer who is killed in the line of duty Proposed law requires the employer of an officer who dies under the same circumstances to provide and pay for health insurance coverage for the law enforcement officer s surviving spouse for two years following the death of the law enforcement officer Requires the employer to provide and pay for health insurance coverage for the law enforcement officer s surviving child for as long as the child remains qualified for the benefit or two years whichever comes first Provides that a child is qualified for the benefit if he is under the age of 18 under the age of 23 and enrolled in and regularly attending a secondary school or a full time student at an accredited college or university or physically or mentally disabled Provides that if health insurance coverage is offered by the employer to active members the health insurance provided to a surviving spouse or child shall be equal in coverage to that offered to active members Many times we see that the survivors of Line of Duty Deaths are burdened with decisions that are strenuous to say the least This would allow the survivor to have the piece of mind to not lose coverage that is desperately needed during trying times The LAFOP supports this Legislation Representative Julie Emerson 306 North Church St Carencro LA 70520 Phone 337 886 4687 Fax 337 886 4689 emersonj legis la gov Find us online at www louisianafop com LAFOP LEGISLATIVE 2018

LAW ENFORCE/OFFICERS:  Provides for the prosecution of officer-involved incidents

Provides for special prosecution procedures in officer-involved incidents which cause serious bodily injury or death to another individual.

Present law provides for the initiation of criminal proceedings through a bill of information or grand jury indictment at the discretion of the district attorney. 

Proposed law provides that in officer-involved incidents, prosecution may only be initiated by grand jury indictment. 

Present constitution (Art. IV, ยง8) authorizes the attorney general to intervene in criminal proceedings in certain circumstances. 

Proposed law requires law enforcement agencies to report officer-involved incidents to the district court with jurisdiction within 72 hours of the incident. The court shall refer the matter to the attorney general, and the attorney general shall either: (1) institute, prosecute, or intervene in the criminal proceeding involving an officer-involved incident, or (2) appoint a special prosecutor to perform the duties of the district attorney who would have otherwise had charge of the prosecution. 

Proposed law defines "officer-involved incidents" and "serious bodily injury".

The LAFOP is opposed to this Legislation.

Prohibits the intentional falsification of reports or records related to the investigation of a complaint or criminal activity and provides criminal penalties for violations of the prohibition. 

Proposed law provides that it shall be unlawful and constitute malfeasance in office for a law enforcement officer to intentionally falsify records or reports related to the investigation of a complaint or criminal activity including but not limited to any documents or reports establishing probable cause to search or arrest an individual. 

Proposed law provides criminal penalties for violations of proposed law which include a fine of not more than $10,000, imprisonment, with or without hard labor, for not more than three years, or both. 

Proposed law defines "law enforcement officer" as including commissioned state and municipal police officers, sheriffs, deputy sheriffs, marshals, deputy marshals, correctional officers, constables, wildlife enforcement agents, and probation and parole officers.

The LAFOP is opposed to this Legislation.

FUNDS/FUNDING:  Provides for reduction to revenues into certain statutory funds

Reduces certain revenue dedications by 50% and requires the amount by which the revenue dedications are reduced to be deposited into the TOPS Stability Fund to fund the Taylor Opportunity Program for Students (TOPS).  One of these funds is the Municipal and Fire and Police Civil Service Office.  In essence the cut to the office would not allow the State Examiner to remain in operation, thereby effecting testing and administration of the system.
