LAW ENFORCE/OFFICERS:  Provides for the prosecution of officer-involved incidents

Provides for special prosecution procedures in officer-involved incidents which cause serious bodily injury or death to another individual.

Present law provides for the initiation of criminal proceedings through a bill of information or grand jury indictment at the discretion of the district attorney. 

Proposed law provides that in officer-involved incidents, prosecution may only be initiated by grand jury indictment. 

Present constitution (Art. IV, §8) authorizes the attorney general to intervene in criminal proceedings in certain circumstances. 

Proposed law requires law enforcement agencies to report officer-involved incidents to the district court with jurisdiction within 72 hours of the incident. The court shall refer the matter to the attorney general, and the attorney general shall either: (1) institute, prosecute, or intervene in the criminal proceeding involving an officer-involved incident, or (2) appoint a special prosecutor to perform the duties of the district attorney who would have otherwise had charge of the prosecution. 

Proposed law defines "officer-involved incidents" and "serious bodily injury".

LAFOP Legislative 2018

Prohibits the intentional falsification of reports or records related to the investigation of a complaint or criminal activity and provides criminal penalties for violations of the prohibition. 

Proposed law provides that it shall be unlawful and constitute malfeasance in office for a law enforcement officer to intentionally falsify records or reports related to the investigation of a complaint or criminal activity including but not limited to any documents or reports establishing probable cause to search or arrest an individual. 

Proposed law provides criminal penalties for violations of proposed law which include a fine of not more than $10,000, imprisonment, with or without hard labor, for not more than three years, or both. 

Proposed law defines "law enforcement officer" as including commissioned state and municipal police officers, sheriffs, deputy sheriffs, marshals, deputy marshals, correctional officers, constables, wildlife enforcement agents, and probation and parole officers.

The LAFOP is opposed to this Legislation.

FUNDS/FUNDING:  Provides for reduction to revenues into certain statutory funds

Reduces certain revenue dedications by 50% and requires the amount by which the revenue dedications are reduced to be deposited into the TOPS Stability Fund to fund the Taylor Opportunity Program for Students (TOPS).  One of these funds is the Municipal and Fire and Police Civil Service Office.  In essence the cut to the office would not allow the State Examiner to remain in operation, thereby effecting testing and administration of the system.
