PRESENT LAW PROVIDES RELATIVE TO MPERS RETIREES WHO RETURN TO WORKCOVERED BY THE SYSTEM. PRESENT LAW, GENERALLY APPLICABLE TO FULL-TIME REEMPLOYMENT, PROVIDES THAT IF THE RETIREE BECOMES AN EMPLOYEE, PAYMENT OF RETIREMENT BENEFITS IS SUSPENDED AND THE EMPLOYEE AND EMPLOYER CONTRIBUTE TO THE SYSTEM TOWARD CREDITABLE SERVICE. UPON TERMINATION OF POST-RETIREMENT EMPLOYMENT, THE RETIREE SHALL RECEIVE AN ADDITIONAL RETIREMENTBENEFIT BASED ON HIS ADDITIONAL SERVICE. PROPOSED LAW RETAINS PRESENT LAW. HB 21RETIREMENTRepresentative Tony BacalaRepublican District 59 PrairievilleThe Louisiana Fraternal Order ofPolice SUPPORTS this LegislationAbstract: Establishes a funding deposit account for the Municipal PoliceEmployees' Retirement System (MPERS) for the purpose of granting andfunding cost-of-living adjustments (COLA). Proposed law establishes afunding deposit account for MPERS. Proposed law authorizes the boardof trustees to require an employer contribution rate up to the followinglimits: (1) (2) When the contribution rate is equal or greater than theprevious year's rate, the board can set the rate .85% greater than thefiscal year's rate. In a fiscal year when the contribution rate is lower thanthe previous year, the board can set the rate at the otherwise requiredrate plus .85% plus half the difference between the rates for the twoyears. Proposed law requires that excess contributions be applied toreduce the outstanding balance of the oldest amortization base or toCOLAs. Proposed law authorizes the board to dedicate a specific amountof the excess contributions, .85% greater than the contribution rate, tofund COLAs. Proposed law provides funds that a COLA shall be paid onlywith funds from the funding deposit account and only when funds aresufficient. Proposed law provides that the board of trustees shalldetermine the following when granting a COLA: (1) (2) (3) (4) Whetherthe COLA is permanent or nonrecurring. Whether the COLA is based onthe retiree or survivor's current or original benefit. Whether a minimumage is required. Whether a retiree or survivor meets minimum periodsince benefit commencement.Proposed law provides that COLApayments may not exceed 3% of benefit or be payable to the retiree orsurvivor until one year since benefit commencement. Proposed lawrequires that an adjustment to benefits due to a COLA be made byformal action by the board of trustees.Passed

Present law provides for a definition of "crime of violence" which means an offense that has, as an element, the use, attempted use, or threatened use of physical force against the person or property of another, and that, by its very nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense or an offense that involves thepossession or use of a dangerous weapon. Present law further provides for a list of certain enumerated present law offensesthat are included as crimes of violence. Proposed law adds the present law (R.S. 14:108.2) Passed

Increases supplemental pay for certain law enforcementofficers and firefighters from $500 per month to $600 per month.Present law provides for state supplemental pay of $100 per month for every justice ofthe peace and every constable for each justice of the peace court in the state.Proposed law increases the state supplemental pay from $100 per month to $120 permonth for eligible firefighters.Present law provides for state supplemental pay of $500 per month for any regularlyemployed firefighter who is paid not less than $300 per month by any municipality,parish, fire protection district, or other political subdivision maintaining a firedepartment, or by the Chitimacha Tribe of La., or Coushatta Tribe of La., or anynonprofit corporation contracting with any political subdivision to provide fireprotection services and who completes one year of service.Present law also provides for state supplemental pay of $500 per month for certain full-time firefighters with the New Orleans port authority or the Plaquemines Port Harbor andTerminal District.Proposed law increases the state supplemental pay from $500 per month to $600 permonth for eligible firefighters.Present law provides for state supplemental pay of $500 per month for any police officerpaid by any municipality or by the Chitimacha Tribe of La., Coushatta Tribe of La., or theTunica-Biloxi Tribe of La., who devotes his full working time to law enforcement, haspassed a council-certified training program, and has completed one year of service.Present law also provides for state supplemental pay of $500 per month for certainpolice officers providing services while patrolling levees, waterways, riverfront areas,and bridges within the city of New Orleans.Proposed law increases the state supplemental pay from $500 per month to $600 permonth for eligible police officers.Nomovemnet

Present law provides such payment in the amountof $500/month. Proposed law increases such supplemental pay from$500/month to $600/month. Present law provides for statesupplemental pay in the amount of $500/month for every full-timeharbor police officer, fireboat employee, and bridge police officer whois paid at least $800/month, completes one year of service, and is post-certified. Provides that such supplemental pay only applies toemployees of political subdivisions of the state. Proposed law increasessuch supplemental pay from $500/month to $600/month. Present lawprovides for payment of supplemental pay of $500/month for eligiblefull-time fire protection officers employed by a port authorityheadquartered in the city of New Orleans. The fire protection officersmust complete one year of service and pass a state or federallyapproved maritime firefighter training program. Proposed law increasessuch supplemental pay from $500/month to $600/month. Present lawprovides for payment of supplemental pay of $500/month for eligiblefull-time fire protection officers employed by the Plaquemines PortHarbor and Terminal District who have completed one year of serviceand passed a state or federally approved maritime firefighter trainingprogram. Proposed law provides that any information obtained in an investigation by means of misrepresentation or deceptive practices by any law enforcement agency or investigator shall not be admissible in any criminal proceeding. Proposed law defines "deceptive practices" as the act, use, or employment of any fraud, false pretense, false promise, or misleading statement by any law enforcement agency, officer, or investigator, with the intent that an individual reasonably believes the information to be true in connection to a criminalinvestigation. Proposed law does not apply to any information obtained by any law enforcement agency, officer, orinvestigator engaged in an authorized undercover investigation.Failed

SB 182LAW ENFORCEMENTSenator Cleo FieldsDemocrat District 14The Louisiana Fraternal Order ofPolice OPPOSES this LegislationPresent law sets forth behavior by public officers and employees that is considered malfeasance in office. Proposed law adds intentionally depriving another of any right protected under the Constitution of Louisiana while acting under color of law to the listof conduct that is malfeasance in office. Present law provides for the mandatory removal of P.O.S.T. certification of any full-time, part-time, or reserve peace officer upon a conviction of malfeasance in office or conviction of an offense which results in the restriction of the officer'sconstitutional right to bear arms. Proposed law retains present law mandatory P.O.S.T. certification revocation provisions and adds two additionalmandatory revocation provisions: (1) (2) A criminal adjudication against the officer for willfully depriving or conspiring to deprive another person of any right protected by the constitution or laws of the United States while acting under color of law. The officer has been terminated by his employing law enforcement agency, or allowed to retire or resign, as a result of disciplinary action taken against the officer for any conductduring the course and scope of employment that would constitute an unauthorized use of force and the officer has exhausted all administrativeremedies. Present law allows the Council on Peace Officer Standards and Training to conduct a revocation hearing to determine if the officer's P.O.S.T. certification should be revoked under certain circumstances including when the officer has been involuntarily terminated by his employing law enforcement agency for disciplinary reasons involving anadjudication of civil rights violations. Proposed law removes the officer's involuntary termination by his employing law enforcement agency for disciplinary reasons involving an adjudication of civil rights violations from the list of revocation offenses over which the Council on Peace Officer Standards and Training has discretion. Effective upon signature of thegovernor or lapse of time for gubernatorial action.Passedamnendedfavorably

Green, Jr.Democrat District 83The Louisiana Fraternal Order ofPolice OPPOSES this LegislationAbstract: Requires sustained complaints to remain in an officer's personnel file, subjectsofficer personnel files with sustained complaints to public records requests, and provides forwhistleblower protection.Present law provides that sustained complaints of a law enforcement officer shall remain in theofficer's personnel file for a period of at least 10 years, but only after the officer has exhaustedall administrative appeals to which he is entitled.Proposed law amends present law to provide that sustained complaints shall remain in anofficer's personnel file permanently and subjects officer personnel files containing sustainedcomplaints to public records requests.Proposed law provides that no police employee shall be discharged, demoted, suspended,threatened, harassed, or discriminated against in any manner in the terms and conditions ofhis employment because of any lawful act engaged in by the employee or on behalf of theemployee in furtherance of any action taken to report malfeasance in office by policeemployees to law enforcement, whether such fellow employee is a co-worker, supervisor orsubordinate.Proposed law provides that a police employee may bring action for relief against his employer,in a court of competent jurisdiction, for damages associated with any action taken by theemployee which is in furtherance of reporting malfeasance in office.Proposed law provides that a person aggrieved of a violation of proposed law shall be entitledto treble damages plus court costs and reasonable attorney fees.Proposed law provides that a plaintiff shall not be entitled to recovery pursuant to proposedlaw if the court finds that the plaintiff instituted or proceeded with an action that wasfrivolous, vexatious, or harassing.Present law (R.S. 40:2531(C)) provides that there shall be no discipline, demotion, dismissal,or adverse action of any sort taken against a police employee or law enforcement officerunless the investigation is conducted in accordance with the minimum standards provided bypresent law.Provides that any discipline, demotion, dismissal, or adverse action of any sort whatsoevertaken against a police employee or law enforcement officer without complete compliance withthe foregoing minimum standards is an absolute nullity.Proposed law repeals present law.Passedamnendedfavorably

HB 702CIVIL IMMUNITYRepresentative Edmond JordanDemocrat District 29The Louisiana Fraternal Order ofPolice OPPOSES this LegislationAbstract: Provides for liability for the deprivation of constitutional rights by peaceofficers.Present law (R.S. 9:2793.1) provides for civil liability immunity for officers fordestruction of property caused while the officer was acting within the course andscope of employment and if necessary to abate a public emergency.Present law (R.S. 9:2798.1) provides for civil liability immunity for policymaking ordiscretionary acts or omissions by public entities. Present law exempts acts oromissions not reasonably related to the legitimate governmental objective or tocriminal or intentional misconduct.Present law (R.S. 9:2800.10) provides for civil liability immunity for damagessustained by a perpetrator of a felony offense during the commission of the offenseor while fleeing the scene.Present law exempts intentional acts involving the use of excessive force.Proposed law (R.S. 9:2800.28) provides that notwithstanding present law, any peaceofficer who subjects or causes to be subjected, including failing to intervene, anyother person to the deprivation of such constitutional rights that create bindingobligations on government actors shall be liable.Proposed law provides for reasonable attorney fees and costs to the prevailingplaintiff. In actions for injunctive relief, a court shall deem a plaintiff to haveprevailed if the plaintiff's suit was a substantial factor or significant catalyst inobtaining the injunctive relief.Present law (C.C.P. Art. 863) provides for attorney or party certification of thefollowing:(1) The pleading is not being presented for any improper purpose.(2) Each claim, defense, or other legal assertion in the pleading is warranted byexisting law or by a nonfrivolous for the extension, modification, or reversal ofexisting law.(3) Each allegation or factual assertion has evidentiary support or is likely to haveevidentiary support after reasonable opportunity for further investigation ordiscovery.(4) Each denial in the pleading of a factual assertion is warranted by the evidence orreasonably based on a lack of information or belief.Failed

HB 702CIVIL IMMUNITYRepresentative Edmond JordanDemocrat District 29The Louisiana Fraternal Order ofPolice OPPOSES this LegislationProposed law provides that under a defendant's motion or upon its own motion, if the courtdetermines that the action seeking damages is frivolous or fraudulent, the court may awardreasonable attorney fees and costs to the defendant, as well as sanctions under present law (C.C.P.Art. 863).Proposed law provides that the rights and remedies provided by proposed law are in addition to anyother rights and remedies provided by law.Proposed law provides that qualified immunity shall not be a defense to proposed law.Proposed law provides that the peace officer's employer shall indemnify a peace officer for anyliability incurred by that peace officer and for any judgment or settlement entered against the peaceofficer for claims arising under proposed law.Proposed law provides that if the peace officer's employer determines that the officer did not actupon good faith and reasonable belief that the act or omission was within the course and scope oftheir lawful powers and duties, then the peace officer shall be personally liable for the lesser of 5%of the judgment or $25,000 and shall not be indemnified by the employer.Proposed law provides that if the peace officer's portion of the judgment is uncollectible from thepeace officer, the employer of the peace officer or employer's insurance shall satisfy the full amountof the judgment or settlement. Proposed law exempts a public entity from having to indemnify apeace officer if the officer was criminally convicted for the conduct from which the claim arises.Proposed law provides for a 3 year prescription for actions brought pursuant to proposed law.Proposed law defines "peace officer" and "public entity".Present law (R.S. 14:134(A)) provides that malfeasance in office is committed when a public officeror employer does any of the following:(1) Intentionally refuses or fails to perform a required duty.(2) Intentionally performs the required duty in an unlawful manner.(3) Knowingly permits another public officer or employee under his authority to intentionallyrefuse or fail to perform any required duty or perform such duty in an unlawful manner.Proposed law (R.S. 14:134(A)) retains present law and provides for malfeasance for a peace officerwho knowingly or with reckless disregard either refuses or fails to perform any duty required of himor performs such duty in an unlawful manner.Present law (R.S. 40:2405(J)(1)) provides that a P.O.S.T. certification of any qualified peace officermay be revoked upon the occurrence of any of the following conditions: (a) a conviction ofmalfeasance in office and (b) a conviction of an offense which results in a peace officer's restrictionof their right to bear arms.Proposed law retains present law but adds that P.O.S.T. certification shall be revoked if the officeris found civilly liable for the use of unlawful force or failure to intervene in the use of unlawfulforce.Failed

HB 663LABORRepresentative Larry FriemanRepublican District 74The Louisiana Fraternal Order ofPolice OPPOSES this LegislationAbstract: Allows teachers, other school employees, and publicemployees to withdraw from paying labor organization dues andallows employees to withdraw from paying professional lawenforcement and firefighter association dues.Proposed law provides that upon submission of a written or emailrequest to his employer, a public employee shall have the right toimmediately cease the withholding of labor organization or unionsdues from his wages. Proposed law further provides that uponreceipt of a request, the employer shall immediately send writtenor email notification of the employee's decision to the labororganization. Proposed law provides that the labor organizationshall cease any withholding of dues from the employee's wages.Proposed law further provides that the employee will not accrueany further debt. Proposed law provides that the employee's rightto immediately resign and immediately end any financialobligation to a labor organization shall not be waived. Proposedlaw provides that all authorizations for labor organization duesshall not exceed one year; and that all authorizations shall berenewed annually in order to be effective. Proposed law furtherprovides that any prior authorizations for organization dues aredeemed invalid. Nomovement

HB 663LABORRepresentative Larry FriemanRepublican District 74The Louisiana Fraternal Order ofPolice OPPOSES this LegislationProposed law provides that proposed law applies only to any newcollective bargaining agreement or contract that is entered into orany existing collective bargaining agreement or contract that ismodified, extended, affected by a new or changed memorandum ofunderstanding, amendment, or is otherwise changed or altered in anyway after proposed law goes into effect. Proposed law provides thatthe requirements of proposed law do not affect any collectivebargaining agreement currently in effect. Proposed law furtherprovides that the terms of the collective bargaining agreement shallremain valid until the adoption of a new collective bargainingagreement or modification, extension, or alteration of an existingbargaining agreement pursuant to proposed law occurs. Proposedlaw provides that the employer shall notify the employee of his rightto cease payment of labor organization dues. Proposed law furtherprovides that the employer shall provide written or emailnotification, at least annually, to the employee to inform him that hecan withdraw from the organization. Proposed law provides that allauthorizations shall be on a form prescribed by the school board andcontain the following statement in fourteen-point boldface font. "Thestate of La. wishes to inform you that you have a 1 st Amendmentright to join or refrain from joining and paying dues to a labororganization. Nomovement

Proposed law providesthat the employer shall confirm the authorization by emailing theemployee at his employer-provided email address or, if he doesnot have an employer-provided email, by other means theemployer deems appropriate.
